This Indenture dated 1626 was the second of a series of Indentures, the first being in 1625. In 1625 Thomas Haige the younger of Mapplewell, Catherine's father, in collaboration with George Beamont of Darton first purchased a 21 year lease from George Carr of Grays Inn, Middlesex to collect tithes and other rents arising in Darton and Mapplewell for 40 pounds. Later TH and GB purchased outright this right to collect the tythes for a sum of 400 pounds. Later GB puchased these rights from TH in stages. The final Indenture being in 1668.

In this second Indenture TH the younger and GB agreed to an equal division of the tithes on the proviso that each paid one half of the £40 per year rent to GC.

As well as its genealogical significance it is also of some historical value as it reveals how tythes were levied and dealt with in this period. Later the Parish Church of Darton regained the rights to the tythes in about 1700.

The Indenture of 1631 refers to Catherine's father Thomas and also to his father Thomas.

The Indenture of 1659 is the one which refers to Robert Robucke and his wife Catherine Haige.


 

"This Indenture made the xiiiith day of January in the first year of the raigne of our soveraigne lord Charles by the grace of god of England Scotland France & Ireland kinge defender of the faith forever. Between Thomas Haighe of Darton in the county of York yeoman on the one partye and George Beamonte of Darton aforesaid yeoman on the other partie. Whereas George Carr of Gray's Inne in the county of Midd gentleman by his Indenture beareinge date the fourteenth daie of October in the first yeare of our sovereigne lord Charles the king ???? that now is due? devise get? set? & to farme let unto the said Thomas Haigh & George Beamonte all his tithes of corne sheaves haye wooll and lambe and all other his tithes oblatons obventons mortuaries and other church duties renewinge arisinge or any waies comeinge or growing due in the towneshippe of Darton and Mapplewell in the said countye of Yorke and all his parte of the tithe barne in Darton aforesaid from the threshing flore there northward with free egresse ingresse & regresse to and from the same (except as in the said Indenture is excepted); To have and to hould the said tithes & premisses with the appurtenance (except before excepted) unto the said Thomas Haigh and George Beamont their executors administrators & assignes from the first day of August then & yet last past before the date hereof until the full end & terme of one & twentye yeares from thense next followinge fully to be compleate & ended. Yielding & payeinge therefore during the said terme unto the said George Carr his heires & assignes at the said tithe barne the full & wist sume of fortie pounds of current english money at two daies in the yeare that is to saye the first day of May and the feast day of Pentecost or within ten daies next after the said daies by even portons as by the said Indenture with d?? other covent & agreement therein conteyned more at large may & doth appeare And Whereas also the said Thomas Haighe and George Beamonte are agreed between themselves that either of the said parties whilst they live and the executors and administrators after their death shall and maye have the one half of the said tithes & duties dureing the said terme payeing the half of the said rent. Now the said Thomas Haighe for him his heires executors & administrators and assignes doth covent promise & grant to and with the said George Beamonte his executors adminstrators and assignes by these presente; that the executors or administrators of the said George Beamonte shall or may receave & take have hould and enjoy the one halfe of all the tithes & premisses granted by the said lease of the said George Carr dureing the residue of the said terme In case the said Thomas Haighe shall survive the said George Beamonte soe that the executors or administrators of the said George Beamonte doe pay the
19 half of the said rent reserved upon the said lease within six daies next after the said first day of Mayand the said feast of Pentecost yeerely unto the said
20 THomas Haighe his executors or assignes yeerely at the dwelling house of the said Thomas Haighe his executors or assigns within the parish of Darton aforesaid dureing the residue of the said terme. And likewise the said George Beamonte for him his executorsand administrators and assignes doth covent promise & grannte to & with the said Thomas Haighe his executors administrators and assignes by those presente that the executors or administrators of the said Thomas Haighe shall & may receave & take have hould and enjoy the one halfe of the said tithes & premisses granted by the said lease of the said George Carr dureing the residue of the said terme. In case the said George Beamonte should survive the said Thomas Haighe soe that the executors or administrators of the said Thomas Haighe doe pay the halfe of the said rent reserved upon the said lease within six daies next after the said first daie of May and the feast of Pentecost yeerely unto the said George Beamonte his executors or assignes yeerely at the dwelling house of the said George Beamonte his executors or assignes within the parish of Darton aforesaid dureing the residue of the said terme; provided allwaies that if the executors or administrators or assignes of him that shall first departe this life shall at any time during the continuance of the said lease faile to pay the ?? half rent due by the said recited lease unto the said partie that shall survive his executors administrators or assignes within six daies next after the first day of May and the feast of Penticost in such sorte? as is aforesaid that then and from thenceforth hee of the said parties that shall survive the other as aforesaid his executors and assignes shall & may have & take all the said tithes & premisses to his & their owne use & uses as in their forme estate? any thing in these present Indentures to the contrary hereof in any wise understanding. And shall from thenceforth pay all the said rente for the said tithes & premisses and thereof save and keep harmelesse the heires executors & administrators of the other of the said parties for ever? In witness whereof the parties above named to these present Indentures x x x interchangeably have set their hands and seales the day & year first above written.

Notes: - Charles became King of England etc. on 27 March 1625 on the death of James I.
By way of the first Indenture dated 14 October 1625 Thomas Haige and George Beamont, together leased the right to the tithes of darton and Mapplewell and diverse goods, with some exceptions, for 21 years from George Carr for a sum of £40 per year.

Later in 1631 were two other similar Indentures this time purchasing the tithes etc. outright from George Carr for £400 dated April and then the other dated October dividing them between TH and GB.

This was confirmed by Royal Charter in 1631
